Question:

Does the use of a premises for the Day Care of Children constitute a change of use under the Building Regulations?


Answer:

  1. If no building work is being proposed, a change of use application under the Building Regulations would only be required if the day care accommodation exceeds 50m² in area (refer table D1 of Approved Document B1 -notes).
  2. If the day care accommodation is being physically separated from the original use, then a change of use (case 5e) will apply requiring a Building Regulation application.

NB: the Dorset Fire and Rescue Service as Agents for the relevant Unitary Authority Social Services should be consulted for other Fire Safety advice.
